Constitution and By-Laws

Article I

Name and Vision Statement

The official name of this organization shall be the Tucker Creek Middle
School Performing Arts Boosters and herein the name Tucker Creek Middle
School Performing Arts includes all instrumental, vocal and visual ensembles
that are provided to students at Tucker Creek Middle School . One hundred
percent of these classes will perform at the highest level possible.

Article II

Purposes and Objectives

Section 1. To provide financial assistance to the Tucker Creek Middle
School Performing Arts Department, within the guidelines set forth by Sec.
1100 Policy 1112.03 of the Craven County School System. This policy governs
organizations.

Section 2. To create among students, faculty members, parents and the
community, a sincere, interest in, and esteem for arts education.

Section 3. To provide for the proper setting for an annual
recognition and awards program for the Tucker Creek Middle School Performing
Arts Students, as needed and requested by the directors.

Section 4. No members of this association are authorized to intervene
in the formulation or carrying out of educational or musical policies for
Tucker Creek Middle School .

Section 5. The Association is not operated for profit and no profit
shall incur to the benefit of any individuals connected with the association,
except in consideration for services rendered.

Section 6. To provide chaperons as needed by the chorus, drama
director, or band director for trips and activities of Tucker Creek Middle
School.

Part 1. Definition: (Chaperon Guidelines follow Craven County Guidelines.)

Part 2. Duties: Chaperon guidelines to be provided by the band chorus,
and/or drama directors. The guidelines will be in alignment with the Tucker
Creek Middle School policies and that of the Craven County Schools.

Article III

Members

Any person, 21 years or older, with a sincere interest in the promotion of
the arts education at Tucker Creek Middle School may become a member of the
Association upon payment of the annual dues. Members shall be required to
fill out a membership information form before membership in the Association
can be finalized.

Article IV

Dues

Section 1. The annual dues shall be $7.00 per band/chorus/drama
family household. Individual membership for friends of the Tucker Creek Middle
School Performing Arts will have annual dues of $5.00

Section 2. Membership shall be from 1 July until 30 June, hereafter
called the charter year.

Section 3. Sponsorship donations in amounts equal to or greater than
the listed will be accepted and recognized as follows:

A. Mustang Family Sponsors- $25.00 Name posted in booster newsletter.


B. Golden Mustang Sponsor-$50.00. Name posted on banner displayed at all
events, and names posted in booster newsletter.

C. Friends of Mustangs Sponsors-$100.00. Name on all programs for all events
during school year, name on sponsors banner displayed at all events, and
name posted in booster newsletter.

D. Corporate Sponsors-$250.00. Name on Wall of Fame posted in the Performing
Arts Wing of Tucker Creek Middle School, name on all programs for all events
during the current school year, name on sponsor banner displayed at all
events, and name posted in booster newsletter.


Article V

Officers

Section 1. The officers of this organization shall be President, Vice-
President, Secretary, and Treasurer. The President, Vice-President, and
Secretary positions may be split into co-officer positions. The Tucker Creek
Middle School band, chorus and drama directors will be advisers to the board
at each meeting.

Section 2. These officers shall perform the duties prescribed in the
by-laws and by the parliamentary authority adopted by this association.

Section 3. No member shall hold more than one office at a time.

Section 4. The term for the officers elected shall be one (1) year, 1
July through 30 June. All officers are eligible for re-election.

Section 5. Duties of Officers.

Part 1. President/Co-President shall preside at all meetings of the
Association and of the Executive Committee, and shall designate the area of
responsibility of each committee appointed. The President/Co-President shall
cast no vote in any matter except in the case of a tie vote. The
President/Co-President shall exercise general supervision over the work of
the Association.

Part 2. Vice President/Co-vice President shall, in the absence of the
President/Co-President, to perform the duties assigned to the President/Co-
President Office. The Vice President/Co-President shall perform the duties
of Parliamentarian, advising the President/Co-President or presiding officer
on points of parliamentary law in order that all business is conducted
properly. The Vice President/Co-vice President will be responsible for
producing or coordinating the publicity requirements of the boosters and in
a similar manner will assist the Tucker Creek Middle School band, drama, or
chorus directors in developing publicity requirements. The Vice
Presidents/Co-vice President shall perform the duties of membership
chairperson.

Part 3. Secretary shall have custody of the Association’s constitution and
by-laws and all other records and documents (except those of the Treasurer) of
the Association. The Secretary shall keep an accurate record of the
meetings/activities of the Association and the Executive Committee. These
records shall transmit to his/her successor. The Secretary shall have charge
of all correspondence.

Part 4. Treasurer shall receive and disburse all Association funds as set
forth below. The Treasurer shall serve as chairperson of the Finance
Committee. The Treasurer shall, upon receipt of funds, deposit said funds in
the designated accounts of a local financial institution. The Treasurer shall
be authorized to maintain separate accounts, which consist of:

Boosters Checking Account will be the money to be spent by band/chorus/drama
directors in accordance with the proposed budget that is presented at the
end of each school year for the following school year. Monies are to be used
at the discretion of the Tucker Creek Middle School band/chorus/drama
directors for the following purposes: trip logistical support,
band/chorus/drama equipment, music/show arrangements, matching funds and any
additional staff.

Band/Chorus/Drama Student Checking Account will be used to hold money
credited to student accounts.

Part 6. Assistant Treasurer can be appointed by the Treasurer to help with
the duties of the Treasurer. The appointment will last as long as needed by
the Treasurer and can be terminated by the Executive Board at any time. The
Executive Board must approve the appointment.

Section 6. The Executive Committee shall consist of the elected
officers of the Association.

Article VI

Elections

A nominating committee will be established at the March meeting to ensure
one or more candidates are nominated for each office. Results will be
provided at the following meeting. The meeting date for elections will be
the first meeting in May. Nominations from the floor may also be taken at
that time. Change of officers will take place the first meeting of July.


Article VII

Meetings

Section 1. The Association shall have one regular meeting each month.
The day of the meeting will be decided upon at the first meeting of the
charter year. A charter year begins in July. Special meetings may be called,
as needed, by the President/Co-President.

Section 2. The Executive Committee shall meet as frequently as
necessary/required.

Section 3. Topics: No member or visitor shall discuss the teaching
methods of the band, chorus, and or drama directors during a regular or
special meeting. Nor shall one discuss one’s child’s, or another student’s,
academic/behavioral performance in these programs. For such discussions, the
concerned party shall arrange a private meeting through the counseling
office at Tucker Creek Middle School.

Article VIII

Quorum and Voting

Section 1. Any six (6) members of the Association shall constitute a
quorum for the transaction of all business of the Association; of the six (6)
total members, at least three (3) officers of the Executive Committee must be
present. A majority of the Executive Committee shall constitute a quorum at
any meeting of the Executive Committee.

Section 2. No proxy votes shall be received or counted.

Article IX

Financial

Section 1. Neither the Association nor its committees shall make any
solicitation of funds on behalf of the Association without authorization from
the directors and principal.

Part 1. All fundraising events, any purchase for the band/chorus/drama, any
function involving students must have approval of the principal. All
activities must follow Tucker Creek Middle School and Craven County School
policies.

Section 2. Checks for payment by the Association must have dual
signatures by the Treasurer and the President.

Section 3. Expenditure authority

Part 1. The President must approve expenditures for requirements that occur
between meetings. The limit for such expenditures is $300.00 per purchase.
Requirements lacking such urgency in the President’s opinion will be
referred to the general membership for discussion and decision at the next
scheduled meeting. Proposed expenditures of $300.00 or less brought to the
floor for discussion may be voted on at the meeting. Proposals may not be
divided into parts to get under the limit.

Part 2. Proposed expenditures in excess of $300.00 will be voted on by the
general population.

Part 3. In-service activities attended by band/chorus/drama
directors requiring booster funds must have been discussed with the executive
board and if necessary the officers. This expense will then be discussed with
the membership. Reimbursement will be given after the training is complete and
with proper dated itemized receipts. The membership will decide on a maximum
amount as described in Article IX, Section 4, Part 2. This includes monies for
substitute teachers.

Section 4. The review of financial record books will occur during the
month of June. This review committee will consist of the Vice
President/Co-vice President, two members, and a non-booster member. The review
should be held at Tucker Creek Middle School with a school Administrator
present. A copy of the final review should be given to the principal, and if
required, the superintendent of Craven County Schools.

Section 5. The boosters shall establish two accounts into which
deposits will be made on behalf of the members and on behalf of the students.
The deposits shall remain the property of the boosters. The student accounts
shall reflect credits earned by the band/chorus/drama members and upon which
they can draw to use for band/chorus/drama trips, musical equipment repairs,
bandchorus/drama camps and other band or chorus related purposes. The
credits, which may be earned, will be determined by majority vote of the
boosters prior to undertaking each fundraiser. When a band/chorus/drama
member graduates or moves, any remaining balance in the account shall be
transferred to the booster account unless a written request to transfer
those funds to a similar performing arts account at Havelock High School,
another TCMS student’s account or Havelock High School use is made by the
student and their parent/guardian. Funds not claimed by 30 June of the
promotion to Havelock High School within thirty (30) days of a move revert
to the Tucker Creek Middle School Performing Arts Booster Account.

Section 7. In the event that the Performing Arts Booster Association
disbands, after payment of all obligations, any remaining monies will be
conveyed at Tucker Creek Middle School. All Association accounts will be
closed and all financial record books turned over to the Tucker Creek Middle
School Financial Secretary. Monies will then be transferred to the Tucker
Creek Middle School’s general fund for performing arts purposes.

Article X

Amendments

This constitution, or any section thereof, may be amended or repealed by two-
thirds vote of the members present at any regular meeting, provided that a
written notice of proposed changes has been provided to the membership at
least ten (10) days prior to the regular meeting. This constitution or any
section thereof may be amended with written notice given to the principal of
Tucker Creek Middle School and the superintendent of Craven County Schools.
